What is Tax Fraud?
With a few exceptions, False Claims Act laws do not cover tax fraud. Instead, since 2006 the Internal Revenue Service has operated a whistleblower program that guarantees financial awards to whistleblowers who expose substantial tax fraud – whether by a company or by an individual taxpayer. Those rewards generally range from 10% to 30% of all unpaid taxes, penalties and interest collected because of the whistleblower’s information. In addition, in accordance with the Taxpayer First Act of 2019, IRS whistleblowers are entitled to protection from retaliation and a variety of remedies. Several states have created similar whistleblower laws and programs covering tax fraud issues.
The attorneys in Mehri & Skalet’s Whistleblower Rights practice group have been working with the IRS, state taxation departments, and the tax whistleblower community for nearly 20 years. We know how to bring tax fraud matters to the Service’s attention, as well as how to coordinate between and among federal and state – and civil and criminal – authorities, to help ensure that our clients’ reports of wrongdoing are investigated promptly and thoroughly.
