What is Tax Fraud?

With a few exceptions, False Claims Act laws do not cover tax fraud. Instead, since 2006 the Internal Revenue Service has operated a whistleblower program that guarantees financial awards to whistleblowers who expose substantial tax fraud – whether by a company or by an individual taxpayer. Those rewards generally range from 10% to 30% of all unpaid taxes, penalties and interest collected because of the whistleblower’s information. In addition, in accordance with the Taxpayer First Act of 2019, IRS whistleblowers are entitled to protection from retaliation and a variety of remedies. Several states have created similar whistleblower laws and programs covering tax fraud issues.
