What is Fraud Against SEC & CFTC Markets?

In the midst of the Bernie Madoff and Allen Stanford multi-billion dollar Ponzi schemes, in 2010 Congress passed the Dodd-Frank Wall Street Reform and Consumer Protection Act. Among many other things, this law created new whistleblower programs for the Securities and Exchange Commission and the Commodity Futures Trading Commission, which allow those agencies to reward whistleblowers who provide information about securities fraud, commodities fraud, crypto-currencies fraud, violations of the Foreign Corrupt Practices Act, and other issues that leads to a sanction exceeding $1 million. Eligible whistleblowers under these programs are generally entitled to between 10% and 30% of the amount of the fine. Notably, some international securities regulators – including the Ontario Securities Commission (which oversees the Toronto Stock Exchange) – operate similar whistleblower rewards programs. And all of these programs offer qualifying whistleblowers protection from retaliation.

M&S attorneys were at the forefront of the passage of the Dodd-Frank statute, worked closely with the SEC and the CFTC to implement the whistleblower programs, and have an unmatched understanding of the law and the programs’ rewards procedures. We represent whistleblowers before both Commissions and are committed to helping our clients protect the investing marketplaces, level the playing field for honest corporations, and receive proper compensation for any retaliation they experience as well as any whistleblower awards due to them.
